What is a Pre-Sentence Investigation?
You are now beginning your Court ordered Pre-Sentence Investigation (PSI). As you are filling out the following questionnaire, you will notice that there are a variety of topics covered. Some questions will pertain to your social information (friends, family, education, etc.), and others will pertain to your criminal record and substance abuse. Answer the questions to the best of your ability, and be as honest as you can. Understandably, it can be difficult to remember dates and ages of when things occurred, so just do your best with this. Also, some of the questions may not pertain to you, so leave those blank or input “n/a.” Furthermore, the questions may repeat themselves. There is a reason for this, so just briefly answer those questions again.
After you complete this questionnaire, your answers will be forwarded to your selected Pre-Sentence Investigator. After your Investigator receives your questionnaire, he or she will call you to schedule a phone interview.
After your information is collected, and your interview is complete, your Investigator will use the information you provide to compile a report for the Judge. The point of this investigation is to make your Sentencing, or Intervention in Lieu of Conviction (ILC) merits hearing, more fair for you as an individual. It is easy to sentence someone based off of his or her prior record and current offense, but this is not always what’s best for that individual. When all of the factors of a person’s life are taken into consideration, a much fairer decision can be concluded. Though some of the questions may seem invasive, keep in mind that this is to your advantage, and all of the information you provide is kept extremely confidential.
To those pursing Intervention in Lieu of Conviction (ILC): the first step of the ILC process is to complete the PSI, and the second part is your ILC Assessment. This is a similar process to the PSI, but it is completed by a treatment center. You will need to refer to the Judgment Entry referring you for ILC to determine where you are ordered to complete your assessment. If you cannot locate this information, please contact your attorney, Pre-Trial Officer, or Pre-Sentence Investigator as soon as possible for that information.
